What is a Guardianship?
This is a process whereby an individual with an interest makes an application to the court to make decisions for an incapacitated adult unable to manage their own affairs. A guardianship order may be required where these decisions are required on an ongoing basis. The powers sought in the application must be proportionate as the court will not grant any that are not necessary or do not benefit the incapacitated adult. Normally a guardianship order lasts for three years but can be for longer in some cases.
