Buying a property can be a very daunting prospect, for first time and experienced buyers alike but it need not be overly stressful.

Making an offer on a property

Noting interest is often the first stage in buying a property as it lets the seller know you are genuinely interested.  Once you have found a suitable property, our conveyancing experts can do this on your behalf.  This effectively requests the selling agents to keep us advised of any developments with the sale of the property and advise us of any upcoming closing date being set for offers for the property.  In Scotland properties are generally placed on the market at an “Offers Over” figure.  The offers over figure will usually be lower than the Home Report valuation (which has been set by the surveyor) and this is to encourage a higher number of prospective purchasers.   Our Conveyancing solicitors can request the Home Report, which consists of the Valuation Report, Energy Report and Property Questionnaire.  We can then guide you on when and what to offer, raising any potential issues before you make an offer on the property.

Buying a property

Once you have an offer accepted, we will then proceed with the conveyancing aspects of purchasing your property.  We will carry out a detailed review of the title to the property, provide you with a report on title, to include a copy of the title deed and relevant plan(s), and examine all the relevant property reports and searches.  If you are getting a mortgage, we will deal with all aspects of processing the release of mortgage funds.  We will meet with you and explain the full effect and obligations to be undertaken by you in respect of the mortgage.  If you have a Help to Buy ISA  or LISA , we can instruct you on how to close your account and can claim the Government bonus for you.  We can also act on your behalf when you are utilising the Scottish Government First Home Fund  or Help to Buy scheme . Following completion of your purchase we will register the mortgage security paperwork along with the title deed in your favour in the Land Register of Scotland.  Once registered, we will provide you with a copy of your title sheet.
